The web application brot.hintermoos.at is only an ordering system for easy and quick ordering of the desired products. The application is operated by a private person, Mr. Jan Kucera, who is not responsible for the quality of the baked goods delivered.

General

1.1 These General Terms and Conditions (hereinafter: GTC) apply to any use of this website and any services we provide to a contractual partner (" customer " or " you ") in connection with the bakery ordering service is willing to provide services only in accordance with these GTC.

1.2 This site orders food, beverages or other everyday items to your home as part of a door-to-door delivery service. Food delivery is provided by a partner. These services via the website brot.hintermoos.at are excluded from the scope of the Act on Distance and Foreign Trade (FAGG) pursuant to Section 1 (2) line 11.

1.3 Orders can only be placed on the basis of the products listed on the website "brot.hintermoos.at" together with the price. Please note that we only sell all products in normal domestic quantities.

1.4 A customer order is an offer to enter into a purchase contract with a partner supplying the product. By checking the box in the shopping cart before submitting the order "I have read and accept the terms and conditions.", the buyer agrees to these general terms and conditions and is bound by them. Upon receipt of the order, we will send a message confirming receipt of the order with its details (order confirmation). This order confirmation does not constitute acceptance of your offer, but is only to inform you that we have received your order. The purchase contract is only concluded when the ordered product(s) are delivered to you. 

2. Order progress, order correction, order cancellation

2.1 By submitting the registration form, you confirm that the information you have provided is correct.

2.2.Registration of an order is only possible if all mandatory fields marked * are filled in the order form. If the information is missing or if we cannot fulfil the order for other reasons, the customer will receive an error message. The customer is given the opportunity to correct their order before the final dispatch of the order. Supporting detailed information will be provided to the customer directly during the order process. Immediately after registering the order, you will receive an order confirmation via e-mail message

2.3 In addition to the required products, the delivery date must also be specified when placing the order.

Once the order process has been completed, you will be notified by the "Order Completed" information window. This does not constitute acceptance of your offer by us.

2.4 The Customer may cancel orders that have been placed but not yet delivered -- even in the current subscription -- until 6:00 p.m. on the business day prior to delivery. Cancellation after 18:00 is no longer possible.

2.5 Deliveries are made on the following days: Monday, Tuesday, Wednesday, Thursday, Friday, Saturday except Sunday.  We do not deliver products on Sundays or public holidays. Deliver only in winter & summer season.

2.6 The risk of loss or damage to the delivery shall pass to the customer.

3. Prices and payments

3.1 Prices are valid at the time of ordering, including statutory VAT plus any costs associated with transport. The current prices of the products published on our website apply. This and a summary of shipping costs are continuously updated and published on the website brot.hintermoos.at.

3.2 Payment may be made by debit or credit card. EU payment details are accepted. When paying by credit card, the order will be charged immediately after the order is completed.

Payment by credit card online:
The customer has the option to pay online using a credit card (Mastercard, Visa and others). When paying by credit card, payment will be made on the same day. The data transfer is encrypted and according to the latest security standards. The customer first selects the desired credit card, then has to enter the credit card number, the expiry date and the so-called card security number (= the three-digit code on the back of your credit card). For transactions that are also processed using Verified by Visa, a password assigned by the customer is also required. After successful confirmation of the order subject to payment, the customer is redirected to the order confirmation page. Credit card payments are processed by our contractual partner stripe (www.stripe.com). When processing the payment, the customer must also comply with the general terms and conditions of the credit company he has appointed. In the event of misuse of the credit card or its details, the authorised cardholder may request the card issuer to cancel or refund the booking or payment.

3.3  You agree to receive orders and all payment information electronically. Information will be sent to the email address you have provided.

4. Delivery costs

Delivery costs are a fixed cost that also include a fee for using the ordering application. The actual price is always available on the order form.

5. Warranty

We do not accept complaints on delivered baked goods, however, we will be glad for any feedback on the quality of delivered products or other information that will improve the service related to the delivery and quality of baked goods.

7.Miscellaneous

Claims for recourse within the meaning of the Product Liability Act are excluded unless the person entitled to recourse proves that the fault was caused by us and was caused by at least gross negligence.
